Terms of service
Last updated 2026-10-23.
1. Who we are
mnemEcho is a product of Invership B.V., Mechelenstraat 66, 4826 KN Breda, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 97741876 ("we", "us"). Contact: [email protected].
2. What these terms cover
These terms govern your use of the mnemEcho Pronunciation API ("the API"), its documentation, and the mnemEcho learner app (together "the service"). By creating an account, using a key or using the app, you accept them. If you use the service for an organisation, you accept them on its behalf and confirm you may do so.
3. Accounts and keys
- Keep your API keys secret. You are responsible for all use made with your keys until you tell us a key has leaked; we then revoke it.
- Give us a working email address. We use it for your account, for notices about the service, and for billing.
- You must be at least 16 years old to hold an account.
4. Fair use
You may not:
- send audio of a person without the right to do so, or audio that is unlawful;
- use the service to identify people by their voice, or to make decisions about a person's health, employment, immigration status or legal rights based on a score alone;
- try to get around limits, share a key outside your organisation, or resell the API as a bare scoring service without our written consent;
- probe, reverse engineer or try to extract our models, or load the service in a way that harms other users;
- claim that a score is an official language exam result.
5. Scores are guidance
Scores are produced automatically and can be wrong, in either direction. Background noise, the microphone, names and loanwords affect them. They are a tool for practice and feedback, not a certificate. Do not use a score as the only basis for a decision that matters to a person.
6. Your content
You keep all rights to the text and audio you send. You give us the limited right to process it to produce the score. API audio and text are processed in memory and discarded after scoring; see the privacy notice. We do not use your content to train models unless you opt in.
7. Plans, payment and limits
- Free use, plans, limits and prices are as shown on the pricing page when you sign up or renew.
- Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- Subscriptions renew automatically until cancelled. You can cancel at any time; the plan then runs to the end of the period you paid for.
- Credit packs are valid for 12 months from purchase. Unused credits expire after that.
- When a limit or quota is reached, requests are refused until it resets or you add more. Refunds are described on the refunds page.
8. Availability and changes
We work to keep the service available but do not promise uninterrupted service, and early access may change quickly. We may change the API; within a major version (such as v1) we keep existing fields and endpoints working. A breaking change comes as a new version, and the old one keeps running for at least six months after notice. We may add fields and flags at any time.
9. Suspension and ending
You can stop using the service and close your account at any time. We may suspend or end access if you break these terms, if payment fails, or if your use endangers the service or others. Where we can, we warn you first. On ending, paid unused periods are handled as on the refunds page, except after a serious breach.
10. Liability
The service is provided as is. To the extent the law allows, we are not liable for indirect or consequential loss, lost profit or lost data, and our total liability in any twelve months is limited to the amount you paid us in that period, or EUR 100 if that is more. Nothing in these terms limits liability for intent or gross negligence, or rights that consumers have under mandatory law.
11. Changes to these terms
We may update these terms. For changes that affect you materially we give at least 30 days' notice by email or on this site. Continuing to use the service after that means you accept the new terms; if you do not, you can stop and close your account.
12. Law and courts
Dutch law applies. Disputes go to the competent court in the district of Zeeland-West-Brabant, unless mandatory consumer law gives you the right to go to the court where you live.
